Skilled Migration Visa

For the General Skilled Migration (GSM) program, applicants must choose an occupation from the MLTSSL (Medium and Long term Strategic Skills list), STSOL (Short Term Skilled Occupation List), or ROL (Regional Occupation List). The GSM employs a points test, awarding points based on factors like age, English proficiency, qualifications, work experience, and special attributes such as Australian qualification completion, prior study in a regional part of Australia, and community language accreditation. A legislative instrument sets the pass mark and pool mark.

To qualify, applicants must be under 45 years old and meet educational, work experience, and English proficiency criteria, with a current pass mark of 65. Immediate family members can be included in the application.

Skilled visas offer professionals the chance to live, work, and study permanently in Australia, with access to free public healthcare. Visa subclass 189 and 190 provide permanent residency, while the 491 Provisional Visa leads to permanent residency upon meeting requirements. After visa approval, unlimited travel to and from Australia is allowed within the first five years. Our expertise at the Australian Migration Centre focuses on subclasses 189, 190, and 491.

Student Visa

Experience Australia’s unique lifestyle while receiving a top-notch education at world-class universities, practical vocational colleges, and exceptional English language schools. For an extended stay, securing an Australian Student Visa is the ideal starting point. Whether studying English, vocational, or university courses, Affinity Migration Lawyers can streamline your application for the best chance of approval.

Australia’s Student Visa Program welcomes overseas students for full-time study in registered courses, allowing them and their dependents to work while residing in the country. The permitted work hours are 48 per fortnight, with no limits for those pursuing masters (research) or doctoral degrees.

Upon completing their Australian study, students become eligible for a post-qualification visa within 6 months, offering temporary residence in Australia ranging from 18 months to 5 years.

Partner/Spouse Visa

To be eligible, applicants must be over 18 and either married or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. Upon approval, a two-year provisional visa will be granted, paving the way for a Permanent Residency Visa (PRV).

Applicants can include their dependent children in the visa application, and this multiple-entry visa comes with healthcare and additional benefits.

Qualify for a spouse visa if:

  • Married to an Australian citizen or permanent resident.
  • In a long-term relationship with an Australian citizen or permanent resident.
  • In a de facto relationship with an Australian citizen or permanent resident.
  • In an interdependent relationship with an Australian citizen or permanent resident.

A spouse visa is initially issued on a temporary basis for two years. Upon successful demonstration of the ongoing and genuine nature of the relationship, the applicant will be granted a permanent visa at the end of the two-year period.

Employer Sponsor Visa

Several pathways exist for individuals seeking an Australian Visa to work either temporarily or permanently in Australia. Employees, along with their families, can potentially reside in Australia for up to 5 years or even indefinitely, depending on the specific visa type. The criteria for employment opportunities are contingent on various factors, encompassing but not limited to:

Temporary Work (TR)

  • Occupation
  • Sponsorship by an Australian company, organisation, government department or Australian resident.
  • Relevant qualifications, skills or experience.
  • English language skills as required.

Employer Sponsored (PR)

  • Age
  • Occupation
  • Sponsorship by an Australian company, organisation, government department.
  • Relevant qualifications, skills assessments and/or work experience.
  • English language skills.
Parent Visa

Permanent Resident Visa:

To be eligible for this visa, you must satisfy the balance of family test, which requires at least 50% of your children and stepchildren to be Australian citizens or permanent residents.

You have the option to apply for either the contributory parent or aged parent visa subclasses. The Parent Visa grants indefinite stay in the country, providing the opportunity to work and access Australia’s public healthcare system. Meeting the required residence criteria eventually leads to eligibility for Australian citizenship.

Temporary Resident Visa

Applicants can choose to stay in Australia continuously for either three or five years, with the possibility of extending the visa for a maximum period of ten years.

For this visa category, the sponsor must be the applicant’s child, and there is no requirement to meet the balance of family test. However, the potential sponsor must furnish evidence demonstrating that they meet the government-specified income threshold to be approved as a sponsor. It’s important to note that only two parents per household can be sponsored for this visa at any given time.

Eligibility:

To qualify for a parent visa, whether for permanent or temporary residency, you must have a sponsor.

The sponsor must be an Australian permanent resident, an Australian citizen, or an eligible New Zealand citizen who is at least 18 years old and has legally resided in Australia for a minimum of 2 years before the parent lodges their visa application.

Business Visa

Australia invites business individuals with skills, expertise, and investments to contribute to the country. Business migrants initially receive a four-year Provisional Visa, which, upon successfully establishing a business or maintaining investments, can be transitioned into a Business Skills Residence Visa for permanent residency.

This visa caters to successful business owners, offering the opportunity to operate either a new or existing business in Australia. Meeting specified criteria qualifies business visa holders for Permanent Residence.

To be eligible, applicants must be under 55 years old, with a minimum annual audited turnover of AU$750,000, and combined net business and personal assets (applicant and partner) of AU$1.25 million. Securing 65 points in the points calculator against specified criteria is also a requirement.
